Konbit Terms of Service

1. Welcome to Konbit

Welcome to Konbit ("Konbit," "we," "our," or "us"). Konbit is a social networking platform designed to connect Haitians and friends of Haiti through communication, culture, community engagement, and content sharing.

These Terms of Service ("Terms") govern your access to and use of the Konbit website, mobile applications, and all related services (collectively, the "Services"). By creating an account or using Konbit, you agree to these Terms. If you do not agree, you may not use the Services.

2. Eligibility

To use Konbit, you must:

  • Be at least 13 years old, or the minimum legal age required in your country.
  • Have the legal capacity to enter into a binding agreement.
  • Comply with all applicable laws and regulations.

If you are under the age of majority in your jurisdiction, a parent or legal guardian must review and agree to these Terms on your behalf.

3. Your Account

You are responsible for:

  • Maintaining the security of your account.
  • Keeping your password confidential.
  • Providing accurate account information.
  • Updating your information when it changes.
  • All activity that occurs under your account.

You agree not to:

  • Share your password.
  • Sell your account.
  • Transfer your account without our permission.
  • Create accounts using false identities.
  • Circumvent account restrictions or suspensions.

4. Community Standards

All users must comply with Konbit's Community Guidelines. You may not use Konbit to:

  • Harass, threaten, or intimidate others.
  • Promote violence or criminal activity.
  • Encourage terrorism or organized crime.
  • Share child sexual abuse material or exploit minors.
  • Impersonate another person or organization.
  • Commit fraud or scams.
  • Spread malware or malicious code.
  • Interfere with the operation of the Services.
  • Violate another person's privacy or intellectual property rights.

Repeated or serious violations may result in suspension or permanent termination of your account.

5. User Content

You retain ownership of the content you create and share on Konbit, including:

  • Photos
  • Videos
  • Audio
  • Comments
  • Messages
  • Profile information
  • Posts

By posting content, you grant Konbit a worldwide, non-exclusive, royalty-free license to host, store, reproduce, distribute, display, and process your content solely for the purpose of operating, improving, promoting, and providing the Services.

This license ends when your content is deleted, except where:

  • Copies remain in backups for a limited period.
  • Content has been shared by others in accordance with the platform's features.
  • We must retain content to comply with legal obligations.

You represent that you have the rights necessary to post your content.

6. Intellectual Property

Konbit owns or licenses all rights in the Services, including:

  • Software
  • Logos
  • Branding
  • Design
  • Trademarks
  • User interface
  • Features
  • Source code
  • Documentation

You may not copy, modify, distribute, reverse engineer, or exploit these materials except as permitted by law or with our written permission.

7. Copyright Policy

Konbit respects intellectual property rights.

If you believe content on Konbit infringes your copyright, you may submit a copyright notice containing:

  • Your contact information.
  • A description of the copyrighted work.
  • The location of the allegedly infringing content.
  • A statement that you believe the use is unauthorized.
  • A statement made under penalty of perjury that your notice is accurate.
  • Your physical or electronic signature.

We may remove allegedly infringing content while reviewing your claim.

9. Purchases and Paid Features

If Konbit offers subscriptions, virtual items, advertising services, or other paid features:

  • Prices will be displayed before purchase.
  • Payments are processed through authorized payment providers.

  • Unless otherwise stated, purchases are non-refundable except where required by applicable law.

Additional terms may apply to specific paid services.

10. Advertisements

Konbit may display advertisements, sponsored posts, or promotional content. Advertising will be clearly distinguishable from user-generated content where reasonably practicable. We are not responsible for the products or services offered by third-party advertisers.

11. Third-Party Services

Konbit may contain links to third-party websites, applications, or services. We are not responsible for:

  • Their content.
  • Their privacy practices.
  • Their terms.
  • Their availability.

Your use of third-party services is governed by their own terms and policies.

12. Account Suspension and Termination

We may suspend or terminate your account if you:

  • Violate these Terms.
  • Violate our Community Guidelines.
  • Engage in fraudulent or illegal activity.
  • Create security risks.
  • Harm other users or the platform.

Where appropriate, we may provide notice and an opportunity to appeal. We reserve the right to act immediately when necessary to protect users, comply with legal obligations, or preserve the integrity of the Services.

You may stop using Konbit and delete your account at any time.

13. Availability of the Services

We strive to keep Konbit available and secure, but we do not guarantee uninterrupted access. We may:

  • Modify features.
  • Add or remove functionality.
  • Perform maintenance.
  • Suspend services temporarily.
  • Discontinue certain services with reasonable notice where appropriate.

14. Disclaimers

Konbit is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee that:

  • The Services will always be available.
  • The Services will be error-free.
  • Content posted by users will be accurate or reliable.
  • The Services will meet every user's expectations.

15. Limitation of Liability

To the maximum extent permitted by law, Konbit and its officers, directors, employees, affiliates, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, goodwill, or business opportunities arising from your use of the Services.

Where liability cannot be excluded by law, it will be limited to the fullest extent permitted by applicable law.

16. Indemnification

You agree to defend, indemnify, and hold harmless Konbit and its affiliates, officers, employees, and agents from claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:

  • Your use of the Services.
  • Your content.
  • Your violation of these Terms.
  • Your violation of another person's rights.
  • Your unlawful conduct.

17. Governing Law

These Terms are governed by the laws of the jurisdiction in which Konbit is incorporated, without regard to conflict-of-law principles, unless otherwise required by applicable consumer protection laws.

Any disputes shall be resolved in the courts with jurisdiction over Konbit's principal place of business, unless applicable law provides otherwise.

18. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify users through the Services, by email, or by other appropriate means before the changes become effective.

Your continued use of Konbit after the effective date of updated Terms constitutes acceptance of the revised Terms.

20. Entire Agreement

These Terms, together with our Privacy Policy, Cookie Policy, Community Guidelines, and any additional terms applicable to specific features, constitute the entire agreement between you and Konbit regarding your use of the Services.

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

    • Rewrote the Terms into 20 clearly numbered sections.
    • Added detailed rules on account eligibility, usernames and account types (personal or business).
    • Clarified that you keep ownership of your content and only grant KONBIT a licence to display it.
