Welcome to KONBIT.
These Terms of Service ("Terms") constitute a legally binding agreement between you and KONBITAPP LLC, a Massachusetts limited liability company ("KONBIT," "we," "us," or "our"), governing your access to and use of KONBIT, including our website, mobile applications, features, software, content, and related services (collectively, the "Services").
By creating an account, accessing, or using the Services, you agree to these Terms, our Privacy Policy, Community Guidelines, and other policies expressly incorporated into these Terms.
If you do not agree, do not use the Services.
1. Eligibility
You must be at least 13 years old to create or use a KONBIT account.
If you are under the age of legal majority where you live, you represent that your parent or legal guardian has reviewed and agreed to these Terms where such consent is required by applicable law.
You may not use KONBIT if:
- You are legally prohibited from receiving or using the Services;
- Your account was previously permanently terminated for serious or repeated violations and KONBIT has not authorized you to create another account; or
- Your use of the Services would violate applicable law.
We may use reasonable age-assurance or verification measures where required or appropriate.
2. Your Account
You are responsible for maintaining accurate account information and protecting the security of your account credentials.
You agree not to:
- Access another person's account without authorization;
- Sell, transfer, rent, or improperly share your account;
- Create accounts for deceptive, fraudulent, abusive, or unlawful purposes;
- Circumvent account restrictions, suspensions, or bans; or
- Use automated systems to create accounts without our authorization.
You are responsible for activity occurring through your account to the extent permitted by applicable law.
If you believe your account has been compromised, notify KONBIT promptly.
3. Community Guidelines
KONBIT is intended to provide a space where people can communicate, share information, express themselves, build communities, and connect with others.
Use of KONBIT is subject to our Community Guidelines.
Content or conduct may be restricted or removed when it violates those Guidelines, these Terms, applicable law, or creates a material safety or security risk.
Our Community Guidelines form part of these Terms.
4. User Content
KONBIT allows users to create, upload, post, transmit, livestream, display, share, or otherwise make available content, which may include:
- Text;
- Photographs;
- Images;
- Videos;
- Audio;
- Comments;
- Messages;
- Profile information;
- Livestreams; and
- Other materials.
Collectively, these materials are called "User Content."
You Own Your Content
As between you and KONBIT, you retain ownership of the intellectual-property rights you have in your User Content.
KONBIT does not claim ownership of your original User Content merely because you post it through our Services.
License You Give KONBIT
When you upload or share User Content through the Services, you grant KONBIT a non-exclusive, worldwide, royalty-free, sublicensable and transferable license to host, store, reproduce, process, modify for technical purposes, adapt, encode, transcode, distribute, display, perform, communicate, publish, translate, create technical derivatives of, and otherwise use your User Content as reasonably necessary to operate, provide, secure, improve, promote, and develop the Services.
For example, this license allows KONBIT to:
- Display your posts to other users;
- Store your content;
- Resize photographs;
- Compress or transcode videos;
- Generate thumbnails and previews;
- Distribute content through content-delivery networks;
- Translate content where translation features are offered;
- Display content across different devices;
- Enable sharing or reposting features;
- Recommend or organize content; and
- Maintain backups and security systems.
The permissions granted under this license are subject to your privacy and visibility settings where applicable.
This license does not transfer ownership of your User Content to KONBIT.
The license generally ends when your User Content is deleted from our systems, except where continued retention or use is reasonably necessary for backups, legal compliance, safety, dispute resolution, content previously shared with others, or other legitimate operational purposes permitted by law.
5. Your Responsibility for User Content
You are responsible for the User Content you submit through KONBIT.
By submitting User Content, you represent that:
- You own the content or have sufficient permission to use it;
- Your submission does not knowingly violate another person's intellectual-property or other legal rights;
- Your submission complies with these Terms and our Community Guidelines; and
- Your use of the content through KONBIT is lawful.
The views expressed by users belong to those users and do not necessarily represent the views of KONBITAPP LLC.
The appearance of User Content on KONBIT does not mean that KONBIT endorses, verifies, sponsors, or agrees with that content.
6. Prohibited Conduct
You may not use KONBIT to engage in unlawful, fraudulent, abusive, deceptive, or harmful activity.
Among other things, you may not:
- Threaten or encourage serious violence;
- Exploit or endanger children;
- Distribute child sexual abuse material;
- Engage in human trafficking or sexual exploitation;
- Distribute non-consensual intimate imagery;
- Engage in sextortion;
- Stalk or seriously harass others;
- Publish sensitive personal information to facilitate harm;
- Impersonate others deceptively;
- Operate scams or fraudulent schemes;
- Distribute malware or malicious code;
- Attempt unauthorized access to accounts, systems, or networks;
- Recruit for or materially facilitate violent criminal activity;
- Sell prohibited illegal goods or services;
- Infringe intellectual-property rights;
- Manipulate KONBIT's systems through unauthorized automation;
- Artificially inflate engagement or account metrics;
- Interfere with the normal operation or security of the Services; or
- Help another person evade enforcement imposed under these Terms.

7. Content Moderation
KONBIT may use a combination of automated systems, technical tools, user reports, moderators, contractors, and other review processes to identify content or conduct that may violate our policies or applicable law.
Where permitted by law, KONBIT may:
- Remove content;
- Reduce content distribution;
- Apply warning labels;
- Restrict recommendations;
- Disable features;
- Restrict livestreaming;
- Limit messaging;
- Require additional account verification;
- Temporarily suspend accounts;
- Permanently terminate accounts; or
- Take other reasonable measures to protect users and the Services.
We may consider factors such as severity, context, intent, potential harm, previous violations, legal obligations, and risk to the community.
KONBIT does not guarantee that it will identify or remove every piece of objectionable, inaccurate, harmful, or unlawful content.
8. Emergency and Illegal Content
We may preserve, restrict, remove, or disclose information where we reasonably believe doing so is required by applicable law or is reasonably necessary to:
- Respond to valid legal process;
- Protect the rights or safety of users or others;
- Investigate fraud or security incidents;
- Address credible threats of serious physical harm;
- Protect KONBIT and its Services; or
- Comply with legally required reporting obligations.
Requests from governments and law-enforcement agencies are subject to applicable law and KONBIT's legal-request procedures.
9. Child Safety
KONBIT has zero tolerance for child sexual exploitation and abuse.
Users may not create, possess through our Services, upload, solicit, distribute, promote, or facilitate content involving child sexual abuse material, grooming, sexual exploitation of minors, sextortion involving minors, or other prohibited sexual exploitation of children.
We may immediately restrict accounts or content associated with suspected child exploitation.
KONBIT may preserve and report qualifying information to the National Center for Missing & Exploited Children, law enforcement, or other appropriate authorities when required or permitted by applicable law.
10. Intellectual Property
Except for User Content and third-party materials, the Services and their associated software, design, branding, logos, graphics, interface elements, databases, and other proprietary materials are owned by or licensed to KONBITAPP LLC and are protected by applicable intellectual-property laws.
Nothing in these Terms grants you ownership of KONBIT's intellectual property.
You may not copy, reproduce, distribute, sell, license, reverse engineer, or commercially exploit protected portions of the Services except as permitted by law or with our written authorization.
11. Copyright and DMCA
KONBIT respects intellectual-property rights.
If you believe content available through KONBIT infringes your copyright, you may submit a copyright complaint pursuant to our Copyright and DMCA Policy.
KONBIT maintains a policy addressing repeat copyright infringers and may restrict or terminate accounts in appropriate circumstances.
Our Copyright and DMCA Policy will provide instructions regarding:
- Copyright notices;
- Required information;
- Counter-notifications;
- Content restoration where appropriate;
- Repeat infringers; and
- Our designated DMCA agent.

12. Privacy
Our collection, processing, use, sharing, and retention of personal information is described in our Privacy Policy.
By using KONBIT, you acknowledge that you have had an opportunity to review the Privacy Policy.
Where required by law, we will request consent separately for particular processing activities.
13. Third-Party Services
KONBIT may contain links to, integrations with, or content provided by third parties.
KONBIT does not control every third-party service and is not responsible for third-party services merely because they are accessible through KONBIT.
Your use of third-party services may be governed by separate terms and privacy policies.
14. Platform Changes
KONBIT is continuously evolving.
We may add, modify, restrict, discontinue, or replace features when reasonably necessary for business, technical, legal, safety, or security reasons.
We do not guarantee that every feature will remain available permanently.
15. Suspension and Termination
You may stop using KONBIT at any time and may request account deletion through available account controls or other methods we provide.
KONBIT may restrict, suspend, or terminate access when we reasonably determine that:
- These Terms were violated;
- Our Community Guidelines were violated;
- An account creates a serious safety or security risk;
- An account is being used unlawfully;
- We are legally required to act;
- Repeated intellectual-property violations occur;
- Fraud or platform manipulation occurs; or
- Continued access creates substantial risk to KONBIT, our users, or third parties.
For serious violations — including child exploitation, credible threats of violence, severe fraud, or serious platform-security abuse — we may take immediate action without prior warning where permitted by law.
16. Appeals
Where KONBIT provides an appeal mechanism, eligible users may request review of certain content-removal, restriction, suspension, or termination decisions.
Submitting an appeal does not guarantee reversal.
KONBIT may restore content or accounts when we determine that enforcement was made in error or circumstances otherwise justify restoration.
Additional procedures may be provided through our Community Guidelines or Moderation and Appeals Policy.
17. Feedback
If you voluntarily provide ideas, suggestions, or feedback regarding KONBIT, you grant KONBIT permission to use that feedback without restriction or compensation to you, provided that this does not transfer ownership of unrelated intellectual property or User Content.
18. Service Availability
We work to maintain reliable Services, but KONBIT is provided on an "AS IS" and "AS AVAILABLE" basis to the fullest extent permitted by law.
We do not guarantee that the Services will always be uninterrupted, secure, error-free, or available.
Outages, maintenance, cybersecurity incidents, technical failures, third-party failures, or circumstances outside our reasonable control may affect availability.
Nothing in these Terms excludes warranties or rights that cannot legally be excluded.
19. Disclaimer Regarding User Content
KONBIT hosts content created by independent users.
To the fullest extent permitted by applicable law, KONBIT does not warrant the truthfulness, accuracy, completeness, reliability, legality, or quality of User Content.
Users should exercise appropriate judgment before relying upon information posted by other users.
Nothing in this section limits responsibilities that cannot legally be waived.
20. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, KONBITAPP LLC AND ITS AFFILIATES, OFFICERS, DIRECTORS, MEMBERS, MANAGERS, EMPLOYEES, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO YOUR USE OF THE SERVICES.
This may include, where legally permitted, loss of profits, data, goodwill, business opportunities, or other intangible losses.
To the fullest extent permitted by law, KONBITAPP LLC's aggregate liability arising out of or relating to the Services or these Terms will not exceed the greater of:
- (a) the amount you paid directly to KONBIT during the twelve months preceding the event giving rise to the claim; or
- (b) $100 USD.
Some jurisdictions do not allow certain limitations of liability. Where those limitations are prohibited, they apply only to the maximum extent permitted by law.
Nothing in these Terms limits liability that cannot legally be limited or excluded.
21. Indemnification
To the extent permitted by applicable law, you agree to defend, indemnify, and hold harmless KONBITAPP LLC and its affiliates, members, managers, officers, employees, agents, and contractors from third-party claims, liabilities, damages, losses, and reasonable expenses arising from:
- Your unlawful use of KONBIT;
- Your material violation of these Terms;
- Your User Content;
- Your infringement or violation of another person's rights; or
- Fraudulent or intentionally harmful conduct through your account.
This provision does not require you to indemnify KONBIT for claims resulting solely from KONBIT's own unlawful conduct where such indemnification is prohibited by law.
22. Governing Law
Except where applicable law requires otherwise, these Terms and disputes arising from them will be governed by the laws of the Commonwealth of Massachusetts, without regard to conflict-of-law principles.
Subject to applicable consumer-protection laws and any dispute-resolution provisions adopted by KONBIT, disputes that must be resolved in court will be brought before a court of competent jurisdiction in Massachusetts.
Nothing in this provision deprives a consumer of protections that cannot legally be waived in the jurisdiction where that consumer resides.
23. Changes to These Terms
We may update these Terms periodically to reflect changes to:
- KONBIT's Services;
- Applicable law;
- Safety practices;
- Technology;
- Business operations; or
- Platform policies.
When changes are material, we will provide reasonable notice where required by law.
The updated Terms will identify their effective date.
Continued use of KONBIT after updated Terms become effective constitutes acceptance where permitted by applicable law.
If applicable law requires affirmative consent to a particular change, we will request it.
24. Severability
If a provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law or severed where necessary.
The remaining provisions will remain in effect.
25. No Waiver
KONBIT's failure to enforce a provision of these Terms does not waive our right to enforce that provision later.
26. Assignment
You may not assign or transfer your rights or obligations under these Terms without KONBIT's written consent.
KONBIT may assign these Terms as part of a merger, acquisition, corporate restructuring, financing, sale of assets, or transfer of the Services, subject to applicable law.
27. Entire Agreement
These Terms, together with policies expressly incorporated into them, constitute the agreement between you and KONBITAPP LLC concerning your use of the Services and supersede prior agreements concerning the same subject matter, except where otherwise expressly stated.
